4. Legal Liability Insurance

All of our professionals have legal liability insurance cover provided by AXA Versicherung AG (Colonia-Allee 10-20, 51067 Cologne). The geographical scope of coverage includes the entirety of the EU as well as those states that are parties to the European Economic Area Agreement. The insurance coverage fulfils the requirements of § 51 BRAO.

6. Consumer Dispute Resolution Act

The consumer dispute resolution body responsible for financial disputes deriving from client relationships according to §36 Consumer Dispute Resolution Act (Verbraucherstreitbeilegungsgesetz) is the Dispute Resolution Board of the Berlin Bar Association at Rechtsanwaltschaft, Rauchstraße 26, 10787 Berlin (www.s-d-r.org). In principle, Kapellmann and Partner Rechtsanwälte mbB are prepared to take part in a dispute resolution process mediated by the Dispute Resolution Board of the Bar.

In the event of a dispute over the performance of a contract, with respect to so-called “online service provision agreements”, users can also make use of new alternatives for out-of-court dispute resolution. Contracts that are entered between a lawyer and a client, who is a consumer, through the website of the lawyer or in some other electronic manner, are online service provision agreements. In the event of a dispute arising out of such an “online lawyer agreement”, the consumer may, in seeking an out-of-court settlement, use the platform for online dispute settlement (OS platform) of the European Commission. The dispute resolution will be performed out of court and exclusively online.
